This Privacy Policy describes what personal information POSTlaMODE collects when you use our website located at www.postlamode.com and our applications (collectively the “Site”, “POSTlaMODE” or “Platform”), how this personal information is used, how this personal information is stored and maybe shared, and the choices and rights you have with respect to this personal information. All access and use by you of our Platform is subject to this Privacy Policy.

The terms “we,” “us,” or “our,” refers to Postlamode LLC (“POSTlaMODE”), a Delaware company headquartered in New York, New York in the United States. We are providing this Platform for you to submit and post content, including your profile information, photos, comments, reviews and other materials (“User Content”), and to share that “User Content” publicly. This means that users of the Platform may search for, see, use, or share any of your User Content that you make publicly available through our Platform, consistent with the practices described in this privacy policy and accompanying Terms of Use.

1. Information We Collect

We collect information and content that you provide us, from third parties, automatically when you visit our Platform, or when you register with POSTlaMODE. We collect information associated with your device using cookies and similar technologies. We may also receive information about your location.

Information and Content You Provide Us

Account information and User Content. We collect the content, communications and other information you provide when you use our Platform, including when you sign up for an account, create or share content, and communicate with us and others. When you create an account on our Platform, we collect information you provide us, such as your name, username, address, email address, telephone number, birthdate, gender, interests, and photos. We collect information and content that you submit or post to our Platform, including your photos, comments, reviews, searches, photo notes, modebooks, and discussions.

Networks and connections. We collect information about the people, pages, and accounts you are connected to and how you interact with them across our Platform. We also collect contact information if you choose to upload, sync or import it from a device (such as an address book or call log or SMS log history), which is used for such things as helping you and others to find people you know.

Transactional information. If you use our Platform for purchases, the relevant third-party transaction payments platforms (accessed through our Platform) collects information about the purchase. This includes payment information such as your credit card information (or bank account information), phone number, billing and shipping addresses, e-mail, and other account and authentication information. When you submit your credit card information, we encrypt that information using industry standard technology and implement commercially reasonable security measures to protect your information from misuse, and do not collect or store that information on our Platform. If that information is collected or stored, it is done so through the relevant third-party transaction payments sites accessed through our Platform to make purchases.

Information from Others

Other platforms. We may receive information about you from third-party platforms that obtain your permission to share your information with us. If you choose to sign-up for our Platform through third-party platform or upload your contacts from your third-party email service, you will be asked to share certain information with us as identified by those third-party platforms.

Other users. We also receive and analyze content, communications and information that other people provide when they use our Platform. This can include information about you, such as when others share or comment on a photo of yours, send a message to you, or upload, sync or import your contact information. If you are a professional or business, Platform users and visitors may provide us with feedback and public reviews about you. If you are a professional or business, we may also collect information about you from publicly available sources and make it available as part of our Platform. For example, we may receive your name and contact information from industry associations and networks in which you participate and display your affiliation with these organizations.

Our partners and third parties. We may receive information about you from our partners and third-parties. For example, advertising partners may help us send communications to you, and third-parties may help us prevent fraud by verifying your contact information. Advertisers, app developers, and publishers can send us information through POSTlaMODE plug-ins, widget, or content, including through POSTlaMODE-branded buttons, badges, and POSTlaMODE co-branded content partnerships. This embedded content provides information to POSTlaMODE pursuant to our use of Cookies as listed below. These partners provide information about your activities on POSTlaMODE including information about your device, websites you visit, purchases you make, the ads you see, and how you use their services whether or not you have a POSTlaMODE account or are logged into POSTlaMODE. For example, a partner could tell us about a purchase you made in its webstore. We also receive information about your online and offline actions and purchases you have made from third-party data providers who have the rights to provide us with your information. These partners receive your data when you visit or use their services or through their third parties or partners. We require these partners to have lawful rights to collect, use and share your data before providing any data to us.

Automatically Collected Information

When you access or use the Platform, we automatically collect certain information from your web or mobile browser, including information about how you use our Platform, such as types of content you view or click on, the features you use, the actions you take, the people or accounts you interact with, and the time, frequency and duration of your activities. For example, we log when you are using and have last used our Platform, and what posts, and other content you view on our Platform. We also collect information that your computer or mobile device provides to us in connection with your use of our Platform, such as your browser type, requested and referring URL’s, number of clicks and how you interact with links on our Platform, type of computer or mobile device, browser language, Internet Protocol (“IP”) address, mobile carrier, unique device identifier, location, and other such information. We may also collect similar information from emails we sent to our Users using MailChimp (www.mailchimp.com). This information will allow us to track which emails were opened and which links were clicked by our Users, and will help us with reporting and improving of the Platform.

We use cookies and similar technologies to show you relevant content, help us understand how our Platform or service is being used, help you navigate between pages efficiently, help remember your preferences, and generally improve your experience in using our Platform. Cookies and similar technologies can also help ensure marketing you see online is more relevant to you and your interests.

Third-Party Cookies. First-party cookies are cookies that belong to POSTlaMODE, third-party cookies are cookies that another party places on your device through our Platform. Third-party cookies may be placed on your device by someone providing a service for POSTlaMODE to help us understand how our service is being used, and to help our business partners advertise products and services to you elsewhere on the Internet. These types of companies use cookies and similar technologies. We may provide advertising networks, advertising partners, and businesses advertising on our platform with aggregate information but other than hashed information or device identifiers, we do not disclose your name, contact information, or other personal information.

How long will cookies stay on a device?

The length of time a cookie will stay on your computer or mobile device depends on whether it is a “session” or a “persistent” cookie. Session cookies will stay on your device until you stop browsing. Persistent cookies stay on your computer or mobile device until they are expired or are deleted.

How to control cookies or other collection technologies?

To change or modify your cookie settings, follow the instructions provided by your website or mobile browser (usually located within the “Help”, “Tools” or “Edit” feature). 2. How We Use Collected Information

We use the information we collect to provide, support, and personalize our Platform and to communicate with you about our Platform (on and off our Platform) in accordance with the POSTlaMODE Terms of Use. Here’s how we use the information we collect:

  • We use the information we collect to provide and improve our Platform’s functionality, including to personalize features and make suggestions for you on and off our Platform, to process, store, and deliver your communications, to provide customer service and support, to respond to your inquiries or requests, to back-up our systems, to fulfill your purchases through our Platform, and to improve the security of our Platform.
  • We use location-related information (if you have allowed us to collect it) such as your current location, where you live, and the businesses and people you have near, in order to provide, personalize, and improve our Platform. We may gather your general location from your IP address. You may also choose to provide us your location information by inputting this information in our Platform in your profile settings.
  • We use the information we collected to develop, test and improve our Platform, including by conducting surveys, contests, promotions, analysis and research, and testing and troubleshooting new features.
  • We use the information we have about you including information about your interests, actions and connections to personalize ads, offers and other sponsored content that we show you, and to evaluate the success of our advertising.
  • We use the information we collect (including your activity off our Platform, such as the websites you visit and ads you see) to help advertisers and other partners analyze the effectiveness and distribution of their ads and services, and understand the types of people who use their services and how people interact with their services.
  • We use the information we have to verify accounts and activity to combat harmful conduct, to detect and prevent spam and other communications that violate our agreements with you, to maintain the integrity of our Platform, and to promote safety and security on our Platform. For example, we use data we have to investigate suspicious activity or violations of our Terms of Use or Privacy Policy.
  • We use the information we have to send you marketing communications, communicate with you about our Platform, and let you know about our policies and terms. We also use your information to respond to you when you contact us.

3. How We Share Collected Information

We share your information with other in the following ways:

Users and visitor. Through our Platform, others may find you and view your public activity on our Platform, for example, if you write a “review” for a professional or business on our Platform, including through your username. If you are a professional or businesses, others may find, contact, and view your profile and public activity on our Platform. For professionals and businesses, once you make your profile “public” and submit content to us, your modebooks, photos, websites, social media profiles, are viewable and open to comments by others. We cannot control Platform visitors’ and users’ use of any information or content you choose to submit to us and available publicly. You can customize your profile and whether users may view you through your profile settings.

Third-party service providers, Platform partners and advertisers. We work with third-party providers who help us provide and improve our Platform, which makes it possible to operate our Platform and provide services to our users. We provide information and content to vendors and service providers who support our business, such as by providing technical infrastructure services, analyzing how our Platform is used, providing customer service, facilitating payments or conducting surveys.

We do not sell any of your information to anyone, and we never will. We share your information with others as reasonably needed for our uses described in this Privacy Policy, and we ask them to limit their use of that information. If you agree to share your information with a third-party partner, for example, as part of a contest or promotion with such third-party, we will share your contact information with that third-party partner.

We work with advertising partners to perform ads on our Platform. We may use advertising partners to communicate with you at the addresses they have for you. We provide advertisers with reports about the kinds of users seeing their ads and how their ads are performing, but we do not share information that personally identifies you unless you give us permission. We also confirm which POSTlaMODE ads led you to make a purchase or take an action with an advertiser. We use advertising networks and companies to perform advertisements on third-party sites and to assist us in evaluating the effectiveness of our advertising. Advertisers on our Platform may also use cookies to track your activities on our Platform. Some of these businesses participate in the Network Advertising Initiative or the Digital Advertising Alliance. Please visit the opt-out pages of these organizations to learn about how you may opt out of receiving personalized ads from participating businesses.

Affiliates and business transfers/ new owner. We may transfer information from or about you to joint ventures or a potential or actual acquirer, successor, or assignee as part of any reorganization, joint venture, merger, sale, transfer, or other disposition including in bankruptcy or similar proceedings of all or any portion of our business, assets, or stock. In these cases, their use of the Platform will be subject to this Privacy Policy.

Investigations. We share information from or about you with law enforcement, as permitted by applicable law, to comply with legal process, law enforcement instructions and orders, such as a search warrant, subpoena, statute, or judicial proceeding served on us, to prevent, investigate, or identify possible wrongdoing in connection with our Platform, to protect our rights, reputation, property, or that of our visitors, users, corporate affiliates, or the public, or to enforce compliance with our Terms of Use agreement with you.

4. Communications

When you sign up (create an account) on our Platform we use the information you provide us to send you marketing communications, communicate with you about your account, communicate with you about our Platform, and let you know about our policies and terms. When you use our mobile app or provide us with your cell phone number, these communications include text messages and push notifications. We may ask for your feedback about your experience in connection with our Platform. We also communicate to you tips, offers, and similar services from POSTlaMODE and may feature professionals, sellers, and other businesses on our Platform in these communications. Our Platform also allows you and others to send messages if you make your contact information available for others to contact you outside our Platform. You may change your communication preferences at any time through your settings and you may also opt-out of similar types of marketing emails from POSTlaMODE directly through the email.

5. Children Under 13

POSTlaMODE is intended for general audiences and is not directed to children under 13. We do not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to register for the Platform. In the event we learn that we have collected personal information from a child under age 13 without parental consent, we will take actions to remove such information and terminate child’s account. If you become aware or believe that a child has provided us with personal information you may contact us (at privacy@postlamode.com).

6. International Transfer of Personal Information

In order to provide you with the services you sign up for by creating a POSTlaMODE account or visiting our Platform, your personal information will be transferred to and processed in the United States (or any other country where we, our corporate affiliates, agents, and service providers operate). Data protection laws differ among jurisdictions, and the United States and these other jurisdictions may not provide the same level of protection for personal information as your jurisdiction of residence. If you are from the European Economic Area (“EEA”) and we transfer your personal information to countries outside of the EEA, we will take appropriate steps to ensure your personal information is afforded the same level of protection as described in this Privacy Policy. If you are located in the EEA or Switzerland, we comply with all legal requirements for the transfer of personal information to countries outside of the EEA or Switzerland.

7. Legal Basis for Processing Personal Information (European Economic Area)

If you are from the EEA, our legal basis for collecting and using the personal information described in this Privacy Policy will depend on the personal information concerned and the specific context in which we collect it. We collect and use your information for a variety of business purposes that are in our legitimate interests, in order to enter into or perform a contract with you, with your consent, or to comply with our legal obligations. 8. Your Data Protection Rights (European Economic Area)

In some regions, such as the EEA, you may have certain rights in relation to your personal information, including the right to access, correct, update, or request deletion of your personal information. POSTlaMODE takes reasonable steps to ensure that the data we collect is reliable for its intended use, accurate, complete, and up to date. You also can manage your profile and settings within our Platform. However, if you are not a user of our Platform and you want to contact us directly about accessing, correcting, updating, or deleting your personal information, or altering your data or marketing preferences, you can do so at any time by contacting us (at privacy@postlamode.com). We will consider your request in accordance with applicable laws.

You can object to processing of your personal information, ask us to restrict processing of your personal information, or request portability of your personal information at any time by contacting us (at privacy@postlamode.com). You also can deactivate your profile through your settings.

You can complain to a data protection authority about our collection and use of your personal information in relation to the General Data Protection Regulation (GDPR). Similarly, if we have collected and processed your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws. We may ask you to verify your identity in order to help us respond efficiently to your request.

We may modify or update this privacy policy from time to time. We will notify you when we make changes to this policy and give you the opportunity to review the revised policy before you choose to continue using our Platform. The most current version of the privacy policy will govern our use of your information.
